1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of the DataAlchemy Platform and related services ("Services") provided by Knowsis (Pty) Ltd ("Knowsis", "we", "us", or "our"), a company registered in South Africa.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
The DataAlchemy Platform is accessible at https://apps.knowsis.work/signup/.
2. Description of Services
The DataAlchemy Platform is a subscription-based software-as-a-service (SaaS) platform providing AI-powered analytics tools for market research and data analysis. The platform includes:
- Ai Data Alchemist — AI-powered methodology advisor
- Description Engine — Interactive data exploration and crosstab analysis
- Distillation Engine — Dimension reduction and index creation
- Prediction Engine — Catalyst driver analysis and impact quantification
- Segmentation Engine — Outcome-based clustering and segmentation
- Synthetic Data Engine — Synthetic data generation (Pro and Enterprise tiers only)
3. Account Registration
To use the Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account and use the Services.
4. Subscription Plans and Payment
4.1 Subscription Tiers
We offer multiple subscription tiers (Trial, Starter, Growth, Pro, and Enterprise) with varying features and usage limits. Current pricing and features are available on our Pricing page.
4.2 Free Trial
New users receive a 14-day free trial with no credit card required. The trial provides access to core platform features with limited usage allowances. At the end of the trial period, you will need to subscribe to a paid plan to continue using the Services. Trial accounts that are not converted to paid subscriptions will have restricted access after the trial period expires.
4.3 Billing
Paid subscriptions are billed in advance on a monthly or annual basis, depending on your selected billing cycle. All fees are quoted in South African Rand (ZAR). Approximate equivalents in other currencies are shown for convenience only and do not constitute a price guarantee.
4.4 Payment Processing
Payments are processed by our third-party payment processor, Paystack Payments South Africa (Pty) Ltd ("Paystack"). By subscribing to the Services, you also agree to Paystack's terms of service. Knowsis acts as the Merchant of Record for all transactions. Paystack processes payments on our behalf but does not control or determine pricing, refund decisions, or service delivery.
4.5 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, your subscription will remain active until the end of the current billing period. Subject to the cooling-off period described in Section 4.7, no refund is provided for the remaining period.
4.6 Price Changes
We reserve the right to modify our pricing. Any price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing cycle.
4.7 Refunds and Cooling-Off Period
Subscription fees are billed in advance and are generally non-refundable once payment has been processed. We encourage all users to evaluate the platform using our free 14-day trial before subscribing. Monthly subscriptions may be cancelled at any time but are non-refundable for the current billing period.
4.7.1 Annual Subscription Cooling-Off Period
If you purchase an annual subscription for the first time, you may cancel within 14 calendar days of your initial payment date and receive a full refund. This cooling-off period applies to first-time annual subscription purchases only and does not apply to subscription renewals. To request a cooling-off refund, contact us at hello@knowsis.net within the 14-day window.
If you cancel an annual subscription after the 14-day cooling-off period, no refund will be issued. Your access to the Services will continue until the end of your current paid subscription term, after which your subscription will not renew.
4.7.2 Exceptions
Limited refund exceptions may apply for:
- Billing errors (e.g., duplicate charges, incorrect amounts)
- Material service failures (e.g., extended outages exceeding 48 hours)
Our default remedy for service issues is a service credit or subscription extension. Refunds are provided only when credits are not practical. For full details, see our Refund Policy.
4.8 Promotional Pricing and Discounts
We may, at our sole discretion, offer promotional pricing, discounts, or complimentary access to higher subscription tiers. Such offers are subject to specific terms communicated at the time of the offer and may be modified or withdrawn at any time. Promotional or discounted pricing does not establish a precedent for future billing periods unless explicitly stated.
5. Usage Limits and Fair Use
Each subscription tier includes specific usage limits (sessions, rows per analysis, AI queries). These limits are designed to ensure fair use and optimal performance for all users.
Fair Use Policy: Excessive automated usage, abuse of the platform, or activities that degrade service quality for other users may result in temporary throttling or suspension of your account.
6. Your Data
6.1 Data Ownership and Definitions
You retain all rights to the data you upload to the platform ("Your Data"). We do not claim ownership of Your Data.
"Outputs" refers to reports, tables, charts, statistical models, or other results generated by the Services based on Your Data. You own any Outputs generated from Your Data and are responsible for downloading and saving Outputs during or immediately after your analysis session.
6.2 Data Processing
By using the Services, you grant us a limited license to process Your Data solely for the purpose of providing the Services to you. We do not use Your Data to train machine learning models or for any purpose other than delivering the Services you have requested.
AI Interactions (Alchemist Chatbot): To improve the Alchemist chatbot and overall service quality, we may review samples of chatbot prompts and responses. Where retained for quality review, such samples are de-identified and not linked back to individual users, unless needed to provide customer support at your request. We recommend that you do not include personal or sensitive information in chatbot prompts.
6.3 Data Security
We implement industry-standard security measures to protect Your Data. However, no method of transmission over the Internet or electronic storage is 100% secure. See our Privacy Policy for more information.
6.4 Data Retention (Session-Based Processing)
The Data Alchemy Platform uses session-based processing. Your Data is uploaded and processed for the duration of your analysis session only. We do not store Your Data as a persistent dataset on the platform. When you close or end a session, any uploaded dataset for that session is no longer retained or accessible.
You are responsible for:
- Maintaining your own copies of any datasets you upload
- Downloading and saving any Outputs (reports, charts, models) you wish to keep before ending your session
We may retain account information, usage logs, audit/security logs, and billing records for limited periods as described in our Privacy Policy.
7. Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services for any illegal, harmful, or fraudulent purpose
- Resell or redistribute access to the Services without our written consent
- Use automated systems to excessively access the Services beyond your usage limits
8. Intellectual Property
The Services, including all software, algorithms, user interfaces, trademarks, and documentation, are owned by Knowsis and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services during your subscription term.
The "Knowsis", "Data Alchemy", and related logos are trademarks of Knowsis. You may not use these marks without our prior written consent.
9. Termination
9.1 Termination by You
You may cancel your subscription at any time through your account settings within the platform, or by emailing us at info@knowsis.net. Cancellation will take effect at the end of your current billing period. You will retain access to the Services until that date. Subject to the cooling-off period described in Section 4.7, no refunds are provided for unused time within a billing period.
9.2 Termination by Us
We may suspend or terminate your access to the Services immediately if you:
- Violate these Terms
- Fail to pay fees when due
- Engage in fraudulent or illegal activity
- Use the Services in a manner that could damage or impair them
9.3 Effect of Termination
Upon termination, your right to use the Services ceases immediately. As described in Section 6.4, we do not retain Your Data as a persistent dataset — the platform uses session-based processing. You are responsible for saving your own copies of any datasets and Outputs you wish to keep prior to termination.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will be uninterrupted or error-free
- The results obtained from the Services will be accurate or reliable
- The Services will meet your specific requirements
The analytical outputs provided by the Services are tools to assist decision-making and should not be considered as professional advice. You are responsible for validating results and making your own business decisions.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KNOWSIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Knowsis, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your Data or content uploaded to the Services
13. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or the Services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the jurisdiction of the courts of the Western Cape, South Africa.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Services at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Knowsis regarding the Services.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.
